CELA to Represent Residents’ Group In Appeal Hearing On Quarry Dewatering Permit

Next week, Ontario’s Environmental Review Tribunal will be holding a long-awaited public hearing on an appeal by Tyendinaga Township residents against the issuance of a water-taking permit for a local quarry.

The hearing will commence on Tuesday, May 19, 2015 at 10:00 a.m. at the Travelodge Hotel, 11 Bay Bridge Road, Belleville. Six hearing days have been scheduled for the appeal.

The hearing will focus upon the Ministry of the Environment’s 2014 decision to issue a water-taking permit to C.H. Demill Holdings Inc. which allows the company to pump millions of litres of water out of an existing quarry in order to facilitate aggregate extraction below the water table.

In October 2014, the Tribunal granted the Citizens Against Melrose Quarry (CAMQ) permission to appeal the permit on the grounds that the Ministry’s decision appeared unreasonable and could result in significant environmental harm. In November 2014, CAMQ filed an appeal which requests the Tribunal to quash or set aside the permit or, alternatively, to impose more stringent terms and conditions to protect the environment and other users of the local groundwater resource.

“We look forward to participating in the Tribunal hearings in order to present our concerns about the potential impacts of quarry dewatering upon nearby private wells and Blessington Creek,” said Susan Munro, Chair of the CAMQ.

“After hearing the parties’ evidence and argument, the Tribunal will be making a binding and enforceable decision,” noted Richard Lindgren, a lawyer with the Canadian Environmental Law Association (CELA) in Toronto. Two CELA lawyers (Mr. Lindgren and Joseph Castrilli) are providing legal assistance to CAMQ.
